- Article 1-Object
- The present terms and conditions govern sales by Waekura SAS, domiciled at 11 rue des Réglises, 75020 Paris, of distance selling by general catalog.
- Article 2-Prices
- The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order), unless otherwise indicated, and exclusive of shipping and handling costs. If you order from a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Waekura SAS. They are your responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to check with your local authorities. All orders, whatever their origin, are payable in euros. Waekura SAS reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time the order is validated and subject to availability. Products remain the property of Waekura SAS until full payment has been received. Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products passes to you.
- Article 3-Orders
- You can place an order on the Internet: www.waekura.comLes contractual information is presented in French and will be confirmed at the latest when your order is validated. Waekura SAS reserves the right not to register a payment or confirm an order for any reason whatsoever, particularly in the event of a supply problem, or in the event of difficulties concerning the order received.
- Article 4-Validation of your order
- Any order placed on the www.waekura.com website implies acceptance of these General Terms and Conditions. Any order confirmation implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation. All data provided and the recorded confirmation will be considered as proof of the transaction. You declare that you are fully aware of them. Confirmation of the order will constitute signature and acceptance of the operations carried out. A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via your order confirmation e-mail address.
- Article 5-Payment
- By confirming your order, you agree to pay the price indicated. Payment for your purchases is made by credit card using the Stripe secure systemThe card is debited once the order has been placed.In the case of split deliveries, only the products shipped are debited.
- Article 6-Withdrawal
- In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify your decision or pay a penalty. Returns must be in their original condition and complete (packaging, accessories, instructions). In this case, your responsibility is engaged. Any damage to the product in this way may be grounds for refusal of the right of withdrawal. Return shipping costs are at the customer's expense. In the event of exercising the right of withdrawal, Waekura SAS will reimburse the sums paid within 14 days of notification of your request, using the same means of payment as that used for the order.
- EXCEPTIONS TO THE RIGHT OF WITHDRAWAL In accordance with the provisions of article L.121-21- 8 of the French Consumer Code, the right of withdrawal does not apply to : The supply of services fully executed before the end of the withdrawal period and whose execution has begun after prior express agreement by the consumer and express renunciation of his right of withdrawal. The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period. - Article 7-Availability
- Our products are offered as long as they are visible on the www.waekura.com website and within the limits of available stocks. If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made. Furthermore, the www.waekura.com website is not intended to sell its products in large quantities. Consequently, Waekura SAS reserves the right to refuse orders of 10 identical items.
- Article 8-Delivery
- Products are delivered to the delivery address indicated during the order process, within the time indicated on the order confirmation page. In the event of a delay in shipment, an e-mail will be sent to inform you of any consequences on the delivery time indicated. In accordance with legal provisions, in the event of late delivery, you have the right to cancel the order in accordance with the terms and conditions set out in article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will reimburse you for the cost of delivery and delivery charges in accordance with article L 138-3 of the French Consumer Code. In the case of deliveries by a carrier, Waekura SAS cannot be held responsible for delays in delivery due exclusively to the customer's unavailability after several proposed appointments.
- Article 9-Guarantee
- All our products are covered by the legal guarantee of conformity and the guarantee of hidden defects, as stipulated in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded. All claims, requests for exchange or refund must be made by e-mail to : [email protected]If you wish to return a product to us, please send us an e-mail within 15 days of delivery, or send us a Facebook message stating: "order number, name, date, product description, reason for return, postal address". Products must be returned in the condition in which they were received, with all accessories, packaging and instructions. Shipping costs will be reimbursed on the basis of the invoiced rate, and return costs will be reimbursed on presentation of receipts, except for orders delivered abroad (outside mainland France), for which return costs remain at the customer's expense and will not be reimbursed. The provisions of this Article do not prevent you from exercising your right of withdrawal under Article 6.
- Article 10-Liability
- The products offered comply with current French legislation. Waekura SAS cannot be held responsible for any failure to comply with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you intend to order. Furthermore, Waekura SAS cannot be held responsible for damage resulting from improper use of the product purchased. Finally, Waekura SAS cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
- Article 11-law applicable in case of litigation
- The language of this contract is French. The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
- Article 12-intellectual property
- All elements of the www.waekura.com site are and remain the exclusive intellectual property of Waekura SAS. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of Waekura SAS.
- Article 13-Personal data
- Waekura SAS reserves the right to collect personal information and data concerning you. We are committed to protecting your personal data, which may also be passed on to companies that contribute to this relationship, such as those in charge of fulfilling orders and services, for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations. Personal data will be kept for a maximum of 12 months. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website. Your proof of identity will be kept for 1 year. - Article 14-Archiving evidence
- Waekura SAS will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code. The computerized registers of Waekura SAS will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
